Walnut Creek, California, DUI/DWI Investigation Lawyer
Typical DUI/DWI legal investigation and defense can include a brief client meeting, a review of the police record and an effort to reduce the charges or the penalty through plea negotiations.
At the law firm of Elle Falahat, attorney Falahat handles DUI/DWI investigations differently. She will not approach your case with the aim of a quick resolution so that she can move on to another case and another fee. We accept a very limited number of cases per month so that we can spend the hours, days and even weeks necessary to fully investigate all aspects of your DUI/DWI charges and provide the best criminal defense we can.
A Commitment to Comprehensive DUI/DWI Legal Investigation
DUI/DWI charges are often vulnerable to diligent legal investigation. Police officers can break laws and commit procedural errors, witnesses can make mistakes, and other witnesses can be located who can provide supportive testimony. My DUI/DWI legal investigation includes:
- A two-hour meeting with you so we can fully review your case and concerns
- A review of the police report
- A visit to the scene
- Interviews with passengers and other witnesses, including people you were out with, and people who were with you before you drove, including bar patrons
- A meeting with the district attorney (DA) prior to your arraignment. By briefing the DA and showing how prepared we are, your case will stand out and the chance for flexibility and leniency increases.
- A review of any blood test results, preliminary alcohol screening (PAS) results, and a check of the breath test results and breath test machine calibration. We will also obtain a copy of the calibration for the breath test machine.
- A motion to put the police officer on the stand. Since police officers generally work hard to avoid testifying, this motion can strengthen your case. Police commonly make errors in conducting and recording field sobriety tests and other procedures.
Our DUI investigation pays off again and again for clients. Police reports are just the beginning, because they are often wrong. Police often do not have the training they are required to have by law, are highly inexperienced, or are overzealous in leveling DUI/DWI charges.
